1. Definitions

• Achievement Specialists Ltd is the provider of the course/coaching.
• 'Participant' means the person entering into agreement with Achievement Specialists Ltd for the purpose of attending an course/coaching.
• The Life Coaching Practitioner Diploma has 3 parts. Part one is the pre-course work. Part two is the 2 day face to face course. Part three is the distant learning element.

2. Booking Conditions

Simply complete your booking form and send it with your investment cheque quoting the course/coaching and the dates you wish to attend along with a current curriculum vitae.

3. Post

We aim to confirm your place on the course/coaching within 24 hours of receiving your completed form and deposit. If you do not hear from us within a working week please contact the office on 07050204941

4. Fees and Extra Value Added Goods and Services

From time to time Achievement Specialists Limited make alterations to the course fee structure the value added goods and services included within the Silver/Gold/Platinum Options. Achievement Specialists Ltd reserve the right to alter the course fee structure the value added goods and services included within the Silver/Gold/Platinum Options at any time without liability. Each and any bookings will be eligible to receive the structure and the value added goods and services included within the Silver/Gold/Platinum Options as published within this website restricted and applicable only to the date on the signed booking form. Please also be aware of Clause 20. Changes to Terms & Conditions. Any additions or deletions to structure or the value added goods and services included within the Silver/Gold/Platinum Options, prior or post booking date will not affect the original booking as the bookings and goods are date related.

5. Payment

Full payment must be made 10 days in advance of the start date (Earlybird 30 days) and should be accompanied by a completed booking form and participant Curriculum Vitae. Cheques should be made payable to 'Achievement Specialists Ltd'. Please write your course/coaching date on the reverse of the cheque along with all correspondence you include.

6. Cancellations & Transfers

Transfer of a course booking to an alternative date is subject to the following charges:

• Transfer requested 15 days or more prior to the start date: charge = 25% of fees
• Transfer requested 14 days or less prior to the start date: charge = 50% of fees

All transfer fees must be paid 30 days prior to the new date of the course selected for transfer and must be taken within the year of transferring.

Cancellation of a course booking is subject to the following charges:

• Cancelled 30 days or more prior to the start date: charge = 25% of fees (75% refunded)
• Cancelled between 15 and 30 days prior to the start date charge = 75% of fees (25% refunded)
• Cancelled 14 days or less prior to the start date charge = 100% of fees (zero refund)
• If a participant fails to attend the course/coaching all fees are forfeited (zero refund)

All deposits are non-refundable.

7. Cancellation by Achievement Specialists Ltd

Achievement Specialists Ltd reserve the right to alter the course/coaching content, alter the course/coaching location, to alter the course delegate numbers at any time without liability.
 
Achievement Specialists Ltd reserve the right to cancel or postpone the course/coaching without liability and participants will be offered an alternative event date, a credit note or a refund.

9. Joining Instructions

You will be sent joining instructions, which will contain details of the location, start times and any other relevant details.

10. Accommodation

All participants of the silver option are responsible for their own residential accommodation. For gold and platinum options, accommodation is provided as described on this website.

11. Participants Obligations

In consideration of any events/courses/coaching to be rendered by Achievement Specialists Ltd under this agreement the participant agrees:-

1. To pay the fee in full, without deductions.
2. To indemnify and keep indemnified Achievement Specialists Ltd from and against any and all liability and loss damage (whether civil or criminal) suffered this also includes legal fees or costs incurred by Achievement Specialists Ltd resulting from a breach of this agreement by the participant his or her employees or agents
3. Not to solicit any of the other participants of Achievement Specialists Ltd courses/coaching
4. That subject to non fulfillment of the terms stated in clause 5 .0 the course/coaching fee is non refundable under any circumstances and is solely at the discretion of Achievement Specialists Ltd
5. Not to cause or permit anything to damage or endanger the intellectual property, or to assist or allow others to do so, of Achievement Specialists. Intellectual property. This includes but is not restricted to copyright, stationery, logo, participant lists, unrecognised design rights, website, course materials and any other item produced by Achievement Specialists.
6. That Achievement Specialists Ltd is not a provider of employment, nor is it an agency for the provision of clients.
7. That the participants success in starting and developing a Life Coaching or coaching practice is exclusively the responsibility of the participant and Achievement Specialists Ltd is in no way liable.
8. That Achievement Specialists Ltd has not made any representation to guarantee success as a Life Coach of any participant in any of the courses/coaching supplied by Achievement Specialists.
9. That in the eventuality Achievement Specialists Ltd is liable to any extent under these terms and conditions or general/common law the liability of Achievement Specialists Ltd is limited to the amount of fee paid by the participant.
10. That any publicity, information, course/coaching agenda, specifications supplied by Achievement Specialists Ltd in relation to the supply of courses/coaching are for guidance only and are subject to reasonable alterations by Achievement Specialists Ltd and at Achievement Specialists Ltd discretion without the prior need to obtain consent from the participant.
11. That Achievement Specialists Ltd is not liable in any manner if the course/coaching contains materials, methods, techniques or any other form of information which the participant is already familiar with.
12. I understand that portions of Achievement Specialists events may be photographed, and/or recorded on video or audiotape. I understand that my likeness may appear on photographs and/or my voice and/or image may appear on video/audio tapes, and I agree that no compensation will be paid to me for any use made of these photographs and audio/video recordings. I waive all rights I may be entitled to over such images or recordings.

12. Materials/documentation

Any material or documents (excluding Curriculum Vitae) submitted to Achievement Specialists Ltd becomes the property of Achievement Specialists Ltd and can be used in any way it sees fit. Photographs of the participants will be taken during the course and may be used for marketing. If you do not agree to your image being used in this manner please inform a member of Achievement Specialists Ltd staff prior to the photographs being taken.

13. Curriculum Vitae

All participants of courses/coaching must provide a written copy of their curriculum before attendance on the event.

14. Money Back Guarantee

The money back guarantee is solely and only at the discretion of Achievement Specialists Ltd. The course/coaching fee is only partially refundable and is solely at the discretion of Achievement Specialists Ltd All and any costs incurred by Achievement Specialists Ltd will be deducted. Guidelines for the Money Back Guarantee will be based on the following conditions.

The participant informs Achievement Specialists Ltd of their desire for their money back before 12 noon on the first day of any face to face courses. All materials and property of Achievement Specialists Ltd are returned immediately in good condition before the participant leaves the course venue. Failure to do this renders the money back guarantee void.

Coaching only programmes (no training included in programme) participant must inform in writing to Achievement Specialists Ltd. of their desire for their money back, during or within 24 hours of the first coaching session of any coaching programmes. Failure to do this renders the money back guarantee void.

All deposits will be non-refundable under any circumstances.

15. Referrals

When a participant/delegate has been referred to become a Life Coach and they attend the Life Coaching Practitioner Diploma course paying the full fee as advertised on the website www.achievementspecialists.co.uk at the time of booking the course, Achievement Specialists Ltd. will pay a referral fee. The fee is at the absolute discretion of Achievement Specialists Ltd. and Achievement Specialists Ltd. reserves the rights to refuse payment any time without liability. Referral fees will also be subject to the following conditions;

The participant/referee has filled in the 'HOW DID YOU HEAR ABOUT THE EVENT OR ACHIEVEMENT SPECIALISTS? Section on the booking form' with a clearly written name, and it has been received by Achievement Specialists Ltd. Where there is any confusion as to who has made the referral (where participant/delegate speaks to more than one person) Achievement Specialists Ltd. reserves the complete and absolute right to decide if, and how, the referral payment is made. Any persons referring participants/delegates to Achievement Specialists Ltd. courses indemnify and keep indemnified Achievement Specialists Ltd. from and against any and all liability and loss damage (whether civil or criminal) suffered this also includes legal fees or costs incurred by Achievement Specialists Ltd. resulting from a breach of this agreement by the referee, participant his or her employees or agents

16. Silver Plus/Gold/Platinum Coaching

Participants who select the Gold, Platinum or Silver Plus Options must take all telephone coaching/mentoring sessions within six months of the date of the workshop they attend. No refunds or date extensions will be given unless expressly agreed in writing from a director of Achievement Specialists Ltd. Failure to arrange and/or take the any or all of the coaching/mentoring sessions within the agreed time frames will render any and all outstanding sessions void. All mentor coaches will be selected by Achievement Specialists. The participants success in starting and developing a Life Coaching or coaching practice is exclusively the responsibility of the participant and Achievement Specialists Ltd is in no way liable. Achievement Specialists Ltd has not made any representation to guarantee success as a Life Coach of any participant in any of the courses/coaching/mentoring supplied by Achievement Specialists. The participant agrees to carry out due diligence on any action taken or decision made during the Gold, Platinum or Silver Plus Coaching/mentoring and it is solely the responsibility of the participant who completely indemnifies Achievement Specialists Ltd or their agents from any liabilities.

17. Disclaimer

The participant is entirely responsible for hiring the services of any of the coaches displayed on this website and understands that none of the coaches are employees of Achievement Specialists Ltd. The participant hires the services of the coach independently of Achievement Specialists Ltd. and is responsible for due diligence when hiring the coach. This disclaimer includes both coaches selected by the participant and coaches selected by Achievement Specialists Ltd.

The participant fully absolves Achievement Specialists Ltd for any liability whatsoever. The participant agrees to indemnify and keep indemnified Achievement Specialists Ltd from and against any and all liability and loss damage (whether civil or criminal) suffered this also includes legal fees or costs incurred by Achievement Specialists Ltd resulting from a breach of this agreement by the participant his or her employees or agents. Achievement Specialists Ltd has not made any representation to guarantee success as a Life Coach of any participant in any of the courses/coaching/mentoring supplied by Achievement Specialists.

18. Participant Numbers

Achievement Specialists Ltd reserves the right to increase and/or decrease the participant numbers as it sees fit and the participant agrees to indemnify and keep indemnified Achievement Specialists Ltd from and against any and all liability and loss damage (whether civil or criminal) suffered this also includes legal fees or costs incurred by Achievement Specialists Ltd resulting from a breach of this agreement by the participant his or her employees or agents as a result of changes made. It is the responsibility of the participant to keep up to date with the current terms and conditions which will at all times be displayed on the website.

19. Participation of Achievers Club

All the details of this particular (19) Term and Condition are reproduced in the Achievers Club as a reminder for you and for your ease of reading and comprehension. Achievement Specialists Ltd, reserves the right to revoke your access to this area and the participant fully absolves Achievement Specialists Ltd for any liability whatsoever. The participant agrees to indemnify and keep indemnified Achievement Specialists Ltd from and against any and all liability and loss damage (whether civil or criminal) suffered this also includes legal fees or costs incurred by Achievement Specialists Ltd resulting from a breach of this agreement by the participant his or her employees or agents.

Posts, files, content, comments and other communications. Users of the Achievement Specialists Ltd web sites (including www.ahievementspecialists.co.uk) may post, questions, comments, communications in the forum; and files or other information in the downloadable area, as long as the content is not objectionable, illegal, obscene, abusive, threatening, defamatory, invasive of privacy. Infringement of intellectual property rights, will not be tolerated, nor will political campaigning, commercial solicitation, chain letters or any form of spam. Impersonation of any person or entity will not be tolerated, nor will any attempt to otherwise mislead as to the origin of any content. Achievement Specialists Ltd reserves the right and not the obligation to remove or edit any content.

If you do post content or submit files or other material, you grant Achievement Specialists Ltd and its affiliates a non-exclusive, royalty-free and fully sub licensable rights to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media; and Achievement Specialists Ltd and its affiliates and sub licensees the right to use the name that you submit in connection with such content, if they choose.

You agree that the rights you grant above are irrevocable during the entire period of protection of your intellectual property rights associated with such content and material. You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to Achievement Specialists Ltd: (i) the content and material is accurate; (ii) use of the content and material you supply does not breach any applicable Achievement Specialists Ltd policies or guidelines and will not cause injury to any person or entity and the content or material is not defamatory. You agree to indemnify Achievement Specialists Ltd and its affiliates for all claims brought by a third party against Achievement Specialists Ltd or its affiliates arising out of or in connection with a breach of any of these warranties.

You agree that your participation in the Achievement Specialists Ltd web sites is entirely at your own risk and that you carry out your own "Due Diligence" on any fact or material that is contained in a posting, comment, offer of service or supply file or other communication and indemnify Achievement Specialists Ltd against any loss consequential or otherwise that you may suffer as a result of participating in any website owned or operated by Achievement Specialists Ltd.

20. Changes to Terms & Conditions

Achievement Specialists Ltd reserves the right to update these terms and conditions as it sees fit and the participant agrees to indemnify and keep indemnified Achievement Specialists Ltd from and against any and all liability and loss damage (whether civil or criminal) suffered this also includes legal fees or costs incurred by Achievement Specialists Ltd resulting from a breach of this agreement by the participant his or her employees or agents as a result of changes made. It is the responsibility of the participant to keep up to date with the current terms and conditions which will at all times be displayed on the website.

21. Miscellaneous

This Agreement will be interpreted, construed and enforced in all respects in accordance with the laws of England and the English Courts shall have non-exclusive jurisdiction in connection with any disputes that arise between you and us. You may not assign or novate or otherwise dispose of this Agreement, by operation of law or otherwise. We shall be entitled to assign or novate this Agreement without your consent. We shall be entitled to sub-contract our obligations and responsibilities under this Agreement to any third party without your consent. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. Notwithstanding any other provision in this Agreement, nothing in this Agreement is intended to confer on any third party any right to enforce any terms of this Agreement (save for any assignee of ours).
